Ken McEwan K.C. and Sandra Foweraker successful in part in overturning court order winding up a strata corporation.

In Owners, Strata Plan VR2122 et al v. Bradbury et al, 2018 BCCA 280, Ken McEwan, K.C. and Sandra Foweraker were successful for the appellants in setting aside part of the order of the Supreme Court of B.C. approving a resolution to wind-up the strata corporation. The case provided the Court of Appeal its first opportunity to consider the recent amendments to the Strata Property Act allowing for the wind up of a strata corporation, pursuant to a prescribed procedure, on resolution by not less than 80% majority of the owners. The case provides important guidance on the procedure to be followed, including in particular the role of the liquidator under the statutory scheme.
